Community Service Possible for Babylon Doc Convicted of Child Porn

A Babylon Village doctor who pled guilty to child pornography charges in 2011 might not spend any time in jail after a judge delayed his sentencing for three years – as long as he volunteers full-time to care for the elderly and need.

According to Newsday, U.S. District Judge Leonard Wexler said he had hope cardiologist Frank Pollaro, a Babylon Village doctor, could be rehabilitated without jail time and allow his community to benefit from his talents. Taxpayers, Wexler said, would not have to bear the burden for Pollaro’s crime.

Pollaro’s lawyer, Stephen Scaring of Garden City, told Newsday it would be hard for his client to support himself this way but the sentence would be better than jail time.

Wexler said Pollaro could work for himself and be paid only after completing 40 hours of community service. Wexler also noted the doctor must work without pay for five years, after which he would only sentence him to probation.

Pollaro pled guilty to a charge of child pornography in 2011 after, his attorney said, he fell into a deep depression and used pornography as an escape.

Only a small portion, Scaring said to Newsday, was child pornography.
